Be aware that many employers are trying to take advantage of the current economic situation to pare their workforce with little expense.  It seems some are letting workers go and then claiming willful misconduct or some other such thing.  All the more reason to get my ebook, Appeal-Winning Strategies.

HELP! MY UNEMPLOYMENT BENEFITS ARE RUNNING OUT!

A lot of folks are running out of uc benefits and have been putting this question out on the web: what happens when my unemployment runs out? Since this is so often asked in this economy, I will place the answer here where everyone can read it. When your initial unemployment runs out, and you still have time left in your base year, you should be able to collect extended benefits until your base year ends. The first extension is for 13 weeks with 7 more weeks added if needed. Then President Obama added another 13 week extension for those states with the highest unemployment rate. This gives you a possible 59 weeks to collect unemployment benefits. However, when your base year ends, you must be tested to see if you qualify for a new uc claim. If you are eligible for a new, regular uc claim, you will receive uc benefits for that claim, even if it is lower than the uc benefits you have been receiving, unless your state makes other arrangements. The Obama extension is scheduled to end on December 31, 2009. The first 20 week extensions are scheduled to end March 31, 2009 to my understanding.


2008 Extensions

THIS IS THE FIRST EXTENSION.

On June 30, 2008, the Supplemental Appropriations Bill, H.R. 2642, was signed into law. It provides for extended unemployment compensation up to 13 weeks for unemployed workers who have exhausted their regular unemployment benefits. The law became effective July 6, 2008, and is scheduled to end March 31, 2009. To be eligible for this extended unemployment compensation, you must have filed a claim for uc benefits after May 2, 2006, and have exhausted all regular unemployment compensation under any state, federal, or Canadian law. The key here is ‘exhausted’, which means that you ran out of benefits and still have some time left in your uc benefit year. If your benefit year runs out and you can re-qualify for regular unemployment compensation, you will be taken off this extended unemployment compensation and go back on regular uc benefits. If you again run out of regular unemployment benefits before this extention ends on March 31, 2009, you can go back on your EUC claim. If you were denied regular uc benefits and have not purged the denial, you will not be eligible for this extension. However, allow the uc office to determine your eligibility and file for the extension.

SECOND EXTENSION 

Congress has passed another extension of unemployment benefits and President Bush has signed it.  This extension will be in addition to the first 13-week extension.  But it is only for seven weeks for most claimants who are running out of benefits.  There may be 13 weeks for those living in states with high unemployment rates but there has been no information on what constitutes a high unemployment state.  To see how your state rates click here:  How does my state rate?

UNEMPLOYMENT COMPENSATION BENEFITS AND FEDERAL TAX FILING

ANSWER: You should receive a 1099-G about the end of January or the beginning of February which states the amount of UC benefits you received and the amount of income tax you had withheld, if any. Use these figures under unemployment compensation on the tax form. Be sure to use the amount of income tax withheld because this is a credit against the total benefits you received. Keep the 1099-G as it contains other information you may need to file your Federal taxes, such as the Federal Employer Identification number.

UNEMPLOYMENT IN THE NEWS

The unemployment rate went up to 9.4% for May, a 0.5 percent jump, and it is expected to keep going up!  Some forecasters expect it to hit double digits sometime this year!  Some states have been in double digits for quite some time.  Be prepared for a long period of unemployment and, for some of you, no money when the extension(s) run out in December.

As of June 20, 2009 the figure for seasonally adjusted initial claims was 627,000, up 15,000 from the previous week's revised figure.  The past 4-week average of initial claims being filed was 617,250, an increase of 5,000 from the previous week's revised average of 616,750.  Experts still project 10% or more by next year.
